N.C. Supreme Court Leaves Annexation Challenge Pending

The North Carolina Supreme Court issued its June decisions today without announcing whether it will hear the challenge brought by opponents to Winston-Salem’s 2003 annexation.
The court is next scheduled to rule on petitions on August 18.
The delay has implications for residents in annexed areas. Should the court in August allow the annexation to go forward, it would not take effect until Sept. 30.
Under state law, taxes for areas annexed after Sept. 1 must be pro-rated for the remaining months of the fiscal year and collected with the following year’s tax bill.
If annexation is allowed to take effect Sept. 30, 2006, residents in annexed areas will not be billed for the pro-rated portion of city taxes for 2006-2007 until they receive bills for the 2007-2008 fiscal year. Those bills would be significantly higher than normal because they would include city taxes for 21 months of services (nine months of 2006-2007 and all 12 months of 2007-2008).
