PROPOSED NIGHTCLUB ORDINANCE THUMBNAIL SKETCH

The Winston Salem Police Department will hold a voluntary training session on the Nightclub Ordinance on Thursday, Oct. 11, from 2 to 5 p.m.

The training will be held in the auditorium of the Public Safety Center, 725 N. Cherry St. The training session is free, but limited to the first 25 participants who sign up by Monday, Oct. 8. To reserve a seat, e-mail Sgt. Tom Peterson at lpeterson@wspd.org or call 462-5504.

Goal: To balance a vibrant nightclub entertainment community and citizens’ safety.

Key concept: Nightclubs that implement the violence reduction program will work with police to curb criminal behavior in nightclubs. Safe nightclubs (see below) and safe nightclub entertainment promoters do not have to hire security.

Nightclubs:

  • Presumed to be a “safe operation” if attend violence reduction program and call police when problems arise.
  • Safe operations have no security requirements.
  • Renewal request from nightclub which has complied with the violence reduction program will not be denied based on criminal incidents occurring at the club.
  • All others must provide security, but may (with three months of safe operation plus attending the violence reduction program) become exempt again from providing security
  • Nightclub appealing proposed suspension/revocation continues to operate with entertainment during the appeal; during a suspension/revocation the nightclub cannot provide entertainment.
  • Nightclub appealing imposition of security requirement following severe violation or a pattern of violations may appeal; must comply with security requirement pending appeal.
  • Includes general requirements (noise, litter removal, etc.).
  • Nightclub’s permit may only be suspended or revoked because of public safety concerns (defined in ordinance) or a continuing violation of which club has been given notice and an opportunity to correct.
  • Emergency suspension stops entertainment only.

Nightclub Entertainment Promoters

  • Non-profit events excluded.
  • Promoters of events for fewer than 100 people are exempt from security requirements.
  • Implements “trial period” under which promoter provides security for first three events before becoming a “safe promoter” exempt from the security requirement.
  • Includes a retroactive provision which allows promoters who can show that they have presented safe events before the ordinance’s effective date to be deemed to be “safe promoters” exempt from the security requirement.
  • Provisions to appeal denials, suspensions or revocations.
  • Nightclub entertainment promoter’s permit may only be suspended or revoked because of public safety concerns (defined in ordinance) or a continuing violation of which nightclub entertainment promoter has been given notice and an opportunity to correct.
  • Emergency suspension stops entertainment only.
