For any development that requires post-construction stormwater control measures (SCMs), part of the permit process requires an Operation and Maintenance Agreement (O&M Agreement) to be approved by the city and recorded by the developer at the Forsyth County Register of Deeds. This agreement consists of the main body of the agreement with signature pages and three exhibits included with each agreement (see Operation and Maintenance Agreement Exhibit templates). 

The O&M agreement that is used for a development depends on who the developer intends to be the long term owner/entity of the SCM. If the developer is to the be long term O&M entity, then the agreement consists of a two party agreement between the developer and the City. If the developer intends a Homeowners Association/Property Owners Association (HOA/POA) to be the long term O&M entity, then the agreement consists of a three party agreement between the developer, the HOA/POA and the City. For HOA/POA agreements, in addition to the O&M agreement, the developer must include an escrow agreement for approval by the City and once approved, recorded by the developer at the Forsyth County Register of Deeds. Note: Should a developer request to amend any language in these agreements, all amendments must first be approved by the City Attorney's office.
